Forms of ownership

Freehold and leasehold — what is possible

Depending on the country and project there are different forms of ownership. I show you which one is actually possible for a specific project.

Freehold (ownership)

You own the property without a time limit. In Thailand this is possible for foreigners for condominium units as long as the project's foreign quota (at most 49 % of the total area) is not used up. In Bali, freehold depends on the project and the legal structure.

Leasehold

You acquire the long-term right to use the land and the villa for a fixed term, for example 25 years plus an extension option. In Bali this is the common and legally clean form for foreign buyers; in Thailand leasehold is mainly used for villas (up to 30 years).

Leasehold in Bali — without the worry

  • For the Kalani villas the lease for the initial term (e.g. 25 years) is included in the purchase price.
  • An extension (e.g. by 10 years) is set out in the contract — for some projects already at a fixed price.
  • Before purchase a notary checks the land register, encumbrances and zoning (due diligence) and notarises the lease.
  • You can usually sell or inherit the remaining term — this depends on the contract.

It is set out in the lease. An extension option (e.g. +10 years) on terms agreed in advance is common. Without an extension the right of use ends and the land reverts to the owner. Ask to see the arrangement in writing before you buy.

For the Kalani villas the lease for the initial term is included in the purchase price. Check this in the contract for each project — including whether ongoing costs such as land tax or service charges apply.

A notarised lease generally stays in place when ownership changes. Have the notary confirm exactly that as part of the review.

You sell the remaining term of the lease. The shorter it is, the lower the value tends to be — which is why the term including any extension option is central to every decision.
